OPINION

KLAPHAKE, Judge.

Appellant Derrell B. White brought a breach of contract action on the termination of his three-year appointment as chairperson of the biology department at respondent Winona State University. The trial court concluded that White's action for breach of contract was non-justiciable and granted summary judgment for respondents. We affirm.
