Defendant Stanley Brewer ("Brewer") is charged with credit card fraud in violation of 18 U.S.C. § 1029(a)(1) and (2). He now moves (1) pursuant to Rules 8(a) and 12(b)(2) of the Federal Rules of Criminal Procedure to dismiss the indictment as duplicitous and (2) pursuant to Rule 12(b)(3) to suppress an out-of-court identification.
