Waitt's motion to dismiss, pursuant to Fed.R.Crim.P. 12, the information filed against him upon the basis that the information fails to charge an offense pursuant to 18 U.S.C. § 213, which makes it a crime for a bank examiner to accept a loan or gratuity from any bank examined by him.
