ZAPPALA, Justice.

This is an appeal by the Commonwealth from an Order of the Superior Court en banc which vacated the judgment of sentence of the Court of Common Pleas of Philadelphia County and reversed the underlying convictions. The Superior Court concluded that Appellee Baxter Hawk's constitutional right to a speedy trial was violated, 390 Pa.Super. 382,
