The facts of this case are fully outlined in this Court's prior opinion dated August 29, 1990, Cowen & Co. v. Merriam, 745 F.Supp. 925 (S.D.N.Y.1990). In that opinion and order, the Court granted a motion by defendants Dori Merriam, James Merriam and Circle Land and Cattle Co. to dismiss Counts 9 and 17 of the Second Amended Complaint. Id....
