Douglas Brown, plaintiff-appellant, filed his petition, styled "Equity Action," against defendant-appellee, Clayton Brokerage Co. of St. Louis, Inc. (Clayton), seeking relief under Neb.Rev.Stat. §§ 48-1228 et seq. (Reissue 1984), the Nebraska Wage Payment and Collection Act. Plaintiff's original petition had "a written contract of employment" attached to it and alleged that Clayton "intentionally and willfully [refused] to pay wages due plaintiff...
