CARR, Justice.

This is an appeal from a judgment rendered in favor of the insured against the insurer in a Stowers1 doctrine case. Based on the jury's findings, the insured elected with the Texas Insurance Code.

Dr. Ramon A. Garcia was defendant in a medical malpractice suit styled Cardenas v. Garcia. Following an adverse judgment in that suit, he sued his malpractice carriers, American Physicians...
