David Smith was indicted by the grand jury of Mobile County, Alabama on a charge of murder, in violation of § 13A-6-2, Code of Alabama 1975. The jury's verdict was "guilty of murder as charged in the indictment." The trial judge sentenced the appellant to 25 years' imprisonment.
