This is an appeal from the Circuit Court of Hinds County, Mississippi, wherein appellant, Joseph Marcum, brought suit against Mississippi Valley Gas Company and its employee Leo Mermelstein, appellees, for injuries received in an accident between Marcum's motorcycle and a Gas Company truck driven by Mermelstein.
