Ordered that the judgment is affirmed.

The defendant was arrested after he and an accomplice beat and robbed an attendant at a Queens gas station while another employee looked on. At trial, the People presented the testimony of the victim and the employee as well as the defendant's written confession. Contrary to the defendant's contention, under the circumstances of this case, we find no error in the court's denial of the defendant's request for a missing witness...
