Craig Crees was charged, in a single trial information, with second-degree theft (a felony) and two misdemeanors. The trial information was approved by a district associate judge.

The jury had been selected and the case was ready for trial. However, the district court, on motion by defendant's counsel, dismissed the felony-related theft charge for the trial information had been approved by a district associate judge rather than a district judge...
