CHAMBERS v. STATE

No. 91-433.

582 So.2d 170 (1991)

David CHAMBERS, Appellant, v. The STATE of Florida, Appellee.

District Court of Appeal of Florida, Third District.

July 16, 1991.

Attorney(s) appearing for the Case

Bennett H. Brummer, Public Defender, and Rosa C. Figarola, Asst. Public Defender, for appellant.

Robert A. Butterworth, Atty. Gen., and Marc E. Brandes, Asst. Atty. Gen., for appellee.

Before SCHWARTZ, C.J., and BARKDULL and GERSTEN, JJ.

CONFESSION OF ERROR

Appellant, David Chambers, appeals an order placing appellant on probation and requiring the payment of restitution as a condition of probation.

Appellant contends, and the State concedes, that portions of the probation order must be stricken because they impermissibly delegate the manner of payment of the restitution to be determined by the probation officer. See Milloway v. State, 567 So.2d 1073
