Defendant, Waldo Short, was charged by bill of information with possession of heroin, a violation of La.R.S. 40:966. He was tried by a twelve-person jury which found him guilty as charged on August 30, 1989. On September 26, 1989 the defendant was sentenced to four (4) years, hard labor, without benefit of parole, probation or suspension of sentence.
