The appellant, Joseph Edward Adler, was originally charged with rape in the first degree but was ultimately convicted of the lesser included offense of sexual abuse in the first degree, a violation of § 13A-6-66, Code of Alabama 1975. He was sentenced to a term of six years in the penitentiary.
