At the time the plaintiffs placed this matter in suit, it was alleged (1) the defendant had consistently violated a special use variance permit and accordingly asked that an injunction issue and (2) the plaintiffs asked for damages against the defendant alleging in substance that defendant's auction business was a nuisance.
