The defendant appeals from the judgment of conviction of one count of assault in the first degree in violation of General Statutes § 53a-59 (a) (3). The defendant claims that the trial court should not have denied his motion to strike a substitute information which added that charge after a prior mistrial on an assault charge arising out of the same incident and brought under a different subdivision of the assault statute.
