The defendant, Frank Dwayne Moseley, was charged with second degree murder, a violation of LSA-R.S. 14:30.1. He was convicted as charged; eleven of the twelve jurors concurred in the verdict. Moseley was sentenced to the statutorily mandated penalty of life imprisonment at hard labor without benefit of probation, parole, or suspension of sentence.
