This case comes before this court for the third time. It does so based on the mandate of the United States Supreme Court entered in this case upon a petition for certiorari granted by that court. The U.S. Supreme Court remanded the case for further consideration in light of an advisory opinion of National Labor Relations Board (NLRB) in the case of Correctional Medical
