Ernest Whittlesey was indicted for theft of property in the first degree, in violation of § 13A-8-3, Code of Alabama 1975. He entered a plea of not guilty by reason of insanity, mental disease, or defect.

Pursuant to a motion for psychiatric evaluation, Whittlesey was transported to Taylor Hardin Secure Medical Facility for evaluation. By order dated May 14, 1990, the circuit court found him to be incompetent...
