On 12 December 1988, defendant was indicted by a Duplin County grand jury for the first-degree murder of Joseph Allen "John Henry" Rivenbark (John Henry). On 22 June 1989, another Duplin County grand jury indicted defendant for robbery with a dangerous weapon, specifically charging him with using an axe to rob John Henry of a .22-caliber revolver, wallet, wristwatch and gold wedding band.
