After drinking with him for several hours, Jack Warren shot his neighbor, Ellery Whitmer, five times with a .22 caliber revolver, causing serious injuries to Whitmer's esophagus, trachea and abdomen. Whitmer was in surgery off and on for 24 hours, and was hospitalized for 5 1/2 weeks.

Warren went to trial for attempted second degree murder, but the jury convicted him of the lesser included offense...
