After a jury trial, the defendant, an Hispanic male, was convicted of aggravated rape, robbery, breaking and entering, and assault and battery. The Appeals Court affirmed the convictions, 20 Mass.App.Ct. 965 (1985), and thereafter the defendant filed several motions including a motion for a new trial which he filed in 1989.
