In the early morning hours of September 16, 1978, someone shot and killed Dutch Reid atop the stoop at 2080 Nostrand Avenue in Brooklyn, New York. Claimant was indicted for murder and illegal possession of a dangerous weapon with respect to this homicide.

The first trial ended in a mistrial when the jury was unable to agree on a verdict. Claimant's second trial was held in November...
