The defendant was convicted after a jury trial in Superior Court (Nadeau, J.) of first degree assault, RSA 631:1 (Supp. 1990). On appeal, the defendant argues that he was denied his State and federal constitutional rights to due process of law and a fair trial when the trial court delayed notifying counsel of the jury's request for supplemental instructions, and when the trial court then refused to issue the instructions...
