This cause came on to be heard upon an appeal from the Hamilton County Court of Common Pleas.
The plaintiffs/relators-appellants ("plaintiffs") have taken the instant appeal from the order of the lower court which overruled their motion for summary judgment and granted the motion for summary judgment filed by the defendant/respondent-appellee ("defendant").
