Defendant and the co-defendant were among a group of young men who participated in a night-time robbery in the Times Square area, which resulted in the murder of the victim. Eyewitnesses positively placed defendant at the scene of the crime. At least one eyewitness observed defendant provoke a confrontation and then "clothesline" the victim, with an extended forearm, by hitting him in the throat area, which knocked the victim off of his feet.
