On May 21, 1989, at approximately 1:55 a.m., defendant, Joseph McHugh, was arrested for driving under the influence of alcohol (75 Pa.C.S. §3731). Defendant was also charged with summary traffic violations. After a preliminary hearing the matter was held for court.
