HOWARD, Judge.

This is an appeal from the trial court's judgment finding that appellee was entitled to 49 percent of appellant's military retirement benefits and the award of a judgment in appellee's favor in the sum of $35,834.37. Appellant concedes that appellee is entitled to 49 percent of his military pension, but contends that the trial court abused its discretion in not applying the doctrine of laches and in granting complete retroactivity.
