1. In these cross-appeals, there are such gross and pervasive deficiencies, attributable to both parties, in the record presented to us that we are unable to review any but two of the issues.

The claims tried below, common law fraud to a jury and G.L.c. 93A to a judge, were presented on the defendant's (Zagami) counterclaims and arose out of a series of bank transactions over a period of about four years in the mid-1970's. The jury trial resulted...
