This is a summary judgment case flavored by a phantom truck driver motioning another motorist into a left turn through an intersection in Olathe, Kansas. The plaintiff's insurance carrier under the uninsured motorist provision of plaintiff's policy is the defendant/appellee.

The propriety of granting summary judgment to the insurance carrier is the issue for resolution.
