This matter is before the Court on two motions filed by Robert Darvin ("Darvin"), one of the defendants, a motion to dismiss pursuant to Fed.R.Civ.P. 12(b)(6) and a motion for sanctions under Fed.R.Civ.P. 11. Darvin's motion to dismiss pertains to Counts I and II of the plaintiff's five-count amended complaint, while the motion for sanctions pertains to the plaintiff's initial complaint.
