COLEMAN, J.

William and Evelyn Crippen appeal the trial court's order granting summary judgment to the City of Bellevue, D.L. Sterling, Ronald Pedee, and Donald Hamilton, arguing that the trial court erred in holding that (1) the municipal fire chief had discretion to refuse to declare a vacancy for a battalion chief position and (2) there were no issues of material fact regarding the fire chief's motivation for refusing to declare a vacancy.
