This matter is before the court on defendant's motion for a new trial based upon newly discovered evidence. Defendant was convicted on January 8, 1986, of third-degree murder in the stabbing death of James Bobbit. He was sentenced to a term of not less than seven nor more than 20 years' imprisonment for that offense.
