This case arises out of an incident in which plaintiff was shot and wounded by defendant Riccinto, an off-duty Detroit police officer, as he was allegedly attempting to burglarize defendant Riccinto's home. Plaintiff claimed tort damages and alleged liability for violation of his federal civil rights. Defendants were granted summary disposition by the trial court.
