This is the fourth time this court has had the pleasure of considering this case, which has yet to go to trial. Plaintiff Edward Hester filed suit in November of 1984 against the International Union of Operating Engineers ("IUOE") and two of its locals, Local 660 and Local 320, alleging that the discipline imposed on him by the unions was improper in several respects.
