This matter comes before the court on an appeal by the plaintiff-appellant, DnC America Banking Corporation ("DnC"), of two orders of the United States Bankruptcy Court. The first granted the defendant-respondent, Topcroft's motion to dismiss and for partial summary judgment and invalidated DnC's mortgage lien.
