DE MUNIZ, Judge.

Defendant was convicted of three counts of sodomy in the first degree, ORS 163.405, and of one count of rape in the first degree. ORS 163.375. We affirm the convictions and remand for resentencing.

Children's Services Division referred a 10 year old child to the Child Abuse Response and Evaluation Service (CARES) after the child's mother reported that she suspected that her former husband had raped their daughter. A pediatrician, Dr. Bays...
