This matter arises out of a landlord-tenant dispute between plaintiff (tenant) and defendant (landlord). It is an action under G.L.c. 186, § 14 for damages because of the defendant's failure to provide water at a house rented to the plaintiff. It is before the Appellate Division on the denial by the Trial Judge of the plaintiff's Motion to Alter or Amend Judgment in this case and in a consolidated small claims case.
