The plaintiff sued the defendant for breach of contract because the defendant refused to pay benefits when the plaintiff was "held-out-of-service."

From the Report we learn that, on April 22, 1988, the plaintiff was the conductor on a train and was injured when the train hit a vehicle on the tracks. The plaintiff's supervisor requested he sign a personal injury questionnaire and undergo a drug test. Plaintiff refused to do so. The parties agree...
