APODACA, Judge.

The New Mexico Superintendent of Insurance and the Subsequent Injury Fund (the Fund) appeal the trial court's judgment entered in May of 1989 on remand. Plaintiff's (Claimant) husband was the injured worker in this appeal. Claimant is the personal representative of his estate. The judgment apportioned liability between employer and the Fund, awarded post-judgment interest, and awarded attorney fees. The Fund raises the following issues...
