This matter is before the court on defendants' motion to dismiss, pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure, and defendants' motion for summary judgment. To the court's knowledge, plaintiff is no longer seeking to proceed with this case as a class action; thus, defendants' motion for denial of certification of class action will be denied as moot.
