THIGPEN, Judge.

This is a simple negligence case, arising out of an automobile accident which occurred September 9, 1988, in which Fran Phillips sustained damages. After an ore tenus proceeding, the trial court found that Ronald Kent Outlaw (appellee) was confronted with a sudden emergency and was not negligent. State Farm Mutual Automobile Insurance Company, as subrogee of Fran Phillips, appeals.
