WAKATSUKI, Justice.

The Department of Defense of the State of Hawaii, (State), employer-appellant, appeals the decision of the Labor and Industrial Relations Appeals Board (Appeals Board) finding claimant-appellee, Kazuo Richard Kaya (Kaya), was injured in the performance of his duty as a Hawaii Air National Guard member, and therefore entitled to workers' compensation benefits under Hawaii Revised Statute (HRS) § 386-161.

We affirm.
