Dr. Walter Cervoni, a pathologist, seeks to recover reimbursement from the Medicare program for certain services rendered to Medicare eligible patients between July 1, 1973 and June 30, 1980. The defendant, the Secretary of Health and Human Services (the "Secretary") takes the position that Dr. Cervoni was already compensated for his work since the salary he received at the hospitals where he performed the services...
