In December 1980, defendant, Steven Paul Linscott, was charged by indictment with three counts of murder (Ill.Rev.Stat. 1979, ch. 38, par. 9-1(a)(2)), two counts of armed violence (Ill.Rev.Stat.1979, ch. 38, par. 33A-2), and a single count of rape (Ill.Rev.Stat.1979, ch. 38, par. 11-1(a)) in the death of Karen Ann Phillips.
