Defendant-appellant Donald Overholt was indicted by a grand jury for the forcible rape, gross sexual imposition, and sexual battery of his seven-year old daughter, Dawn. In a second indictment he was charged with sexual battery and forcible rape of Dawn's six-year-old friend, Tasha Cornwell. The cases were consolidated for trial.
