Defendant, Bertha Swafford, was tried by jury and convicted of one count of possession of marijuana with intent to distribute and five counts of distribution of marijuana pursuant to LSA-R.S. 40:966. Thereafter she was found to be a second felony offender pursuant to LSA-R.S. 15:529.1 because of a prior conviction for possession of marijuana with intent to distribute.
