In May 1990 a jury convicted David Belanger of possession with intent to distribute marijuana and being a felon in possession of a firearm. At sentencing, the district court determined that Belanger had been previously convicted of two controlled substance felonies, and therefore sentenced him under the career offender provisions of the Sentencing Guidelines.
