Justice HARTMAN delivered the opinion of the court:

Co-defendants, Edwin Suarez and Carlos Creasy, were jointly indicted for murder and three counts of attempted murder arising from a September 26, 1985 shooting at a tavern, which left one person dead and three others wounded. Defendants were granted a trial severance. A jury found Suarez guilty of murder and attempted murder. He received a 40 year sentence for the murder...
