Plaintiffs, Andrew and Lillian Nyczepir, appeal a judgment of the Superior Court (Cumberland County, Perkins, J.) upholding the decision of the Town of Naples Board of Appeals which denied their appeal of the Code Enforcement Officer's ("CEO") refusal to issue them a building permit. Plaintiffs argue on appeal that the Superior Court erred in accepting the Board's interpretation of section 8(C) of the Naples Shoreland Zoning Ordinance. We disagree...
